Law No. (23) Of 2018 issuing the Health Insurance Law.

We, Hamad bin Isa Al Khalifa, King of the Kingdom of Bahrain.

After reviewing the constitution and the laws listed include:

  • Law No. (13) Of 1975 regarding the regulation of pensions and benefits for government employees and its amendments,
  • The Social Security Law issued by Decree Law No. (24) Of 1976 and its amendments.
  • Decree Law No. (2) Of 1987 regarding the practice of non-doctor medical professions, amended by Decree Law No. (21) Of 2015 regarding private health institutions.
  • Law No. 7 of 1989 regarding the practice of human medicine and dentistry.
  • Law No. 18 of 1997 regulating the pharmacy profession and pharmacy centers, amended by Law No. 20 of 2015.
  • Civil Law issued by Law No. 19 of 2001.
  • Financial and Administrative Audit Law issued by Law No. 16 of 2002, amended by Law No. 49 of 2010.
  • Law No. 39 of 2002 regarding the general budget and its amendments.
  • Criminal Procedures Law issued by Law No. 46 of 2002 and its amendments.
  • Law No. 19 of 2006 regarding the regulation of the labor market and its amendments.
  • The Central Bank of Bahrain and Financial Institutions Law issued by Law No. 64 of 2006 and its amendments.
  • Law No. 32 of 2009 establishing a pension and retirement benefits fund for members of the Shura Council, Parliament, and local councils and regulating their pensions and benefits.
  • Law No. 35 of 2009 regarding the treatment of a Bahraini woman married to a non-Bahraini and of Bahraini children married to a non-Bahraini with regard to some fees imposed on government services.
  • Law No. 38 of 2009 regarding the establishment of the National Health Regulation Authority, amended by Decree No. 32 of 2015

The Supreme Council and the National Assembly hereby enact the following law, which we have approved and enacted:

Article 1

The provisions of the accompanying law shall be implemented in relation to the health insurance system.

Article 2

It is the responsibility of the Prime Minister and the Ministers, each in his respective capacity, to enforce the provisions of this law, and the provisions of the accompanying law shall be implemented starting from the first month following six months from the date of its publication in the official gazette, without prejudice to the stages of implementation referred to in paragraph (g) of Article 2 of the accompanying law.

Duties:

Article (5)

The duties and powers of the fund,

  1. The fund is responsible for financing health benefits for individuals covered under its insurance, ensuring ease and speed of access to health services. To achieve this, the fund performs all necessary tasks and exercises necessary powers.
    1. Contracting with health service providers to offer health benefits to individuals covered by the fund.
    2. Collecting, analyzing, and compiling data and information related to individuals covered by the fund.
    3. Issuing rules and procedures for collecting health insurance contributions, in coordination with relevant government agencies.
    4. Possessing, managing and investing any financial and real estate resources of the fund.
    5. Coordinating with the Supreme Health Council and relevant authorities on all issues related to implementing the health insurance system.
    6. Proposing programs and policies aimed at improving the health insurance system in areas beyond the fund's jurisdiction and providing relevant authorities with the same.
    7. Organizing training and educational programs and seminars with the aim of raising awareness of the provisions of this law, spreading awareness in all fields of the health insurance system, conducting and supporting research and studies in this field, and working to benefit from their results, in coordination with the Supreme Health Council.
    8. Expressing opinions on health insurance system related law projects, regulations and decisions issued by relevant authorities, in coordination with the Supreme Health Council.
    9. Studying related laws and regulations to assess whether they include provisions that hinder or facilitate the development of the health insurance system, and proposing modifications according to constitutional mechanisms.
    10. Receiving complaints and grievances related to insurance coverage provided by the fund, examining them, and making decisions on their validity.
    11. Performing other tasks and responsibilities specified in this law.
  2. The Fund, in carrying out its duties, may seek the assistance of those deemed appropriate, with suitable competence and experience, from both government and non-government entities. In the event that the task of collecting fees or subscriptions is delegated to a non-government entity, this must be published in the official newspaper.
  3. The Fund must carry out its duties and responsibilities with competence, efficiency, transparency, and without discrimination, in accordance with the general policy of the state with regard to health insurance.

Concerning the Formation of the Board of Directors of the Health Insurance Fund

We, Hamad bin Isa Al Khalifa, Ruler of the Kingdom of Bahrain, after considering the Constitution, the Health Insurance Law (Law No. 23 of 2018, with a particular focus on Article 7), and Decree No. 19 of 2014 concerning the compensation of chairs and members of government councils and committees, in accordance with the recommendation of the Higher Health Council and upon the suggestion of the Prime Minister, and with the endorsement of the Council of Ministers, do hereby decree:

Article 1

A board of directors of the Health Insurance Fund shall be established, with the chairman of the supreme Council of health as its head, and with the following members:

  1. Minister of Finance and National Economy, Vice-President.
  2. The Minister of Health
  3. The Minister of Labor and Social Development
  4. The Governor of the Central Bank of Bahrain
  5. Aisha Mubarak Jaber Buang.
  6. Muhammad Ibrahim Al-Shorouki.
  7. Attorney Farid Ghazi Rafi.
  8. Jassim Hassan Abdel-Aal.

The term of membership for non-chairman and non-ministers shall be four years, renewable for a similar period. In the absence or impediment of the chairman, the deputy chairman shall take his place.

The board of directors of the Health Insurance Fund.
